Military Or Jail - A drill instructor at Alpha Company, 1st Staff Training Battalion, San Diego, Sept. 26, 2016.

There is an old era of judges ordering people to "join the military or go to jail" after committing petty crimes. Logically, a few years of discipline and hard work would get them straight instead of in prison. But it may be time to end the practice, especially if people convicted of crimes like sexual assault can get that offer from local courts.

Military Or Jail

Military Or Jail

A Kentucky judge recently offered the option of recruiting a prison guard accused of sexually assaulting a female inmate as a way to avoid prison. And a Florida state senator recently introduced legislation that would offer equal parole for those convicted of nonviolent crimes.

But regardless of a Florida state senator's recommendation or a Kentucky court order, the military has no obligation to recruit anyone.

Army Regulation 610-210, which contains guidelines for enlistment, states that applicants are ineligible for enlistment if "[t]hey are ordered by a civil or criminal court as a condition of any civil penalty or adverse disposition or for any other reason." given or accepted.” Status. Declaration or required sentence of enlistment in the Armed Forces of the United States.” Other branches follow similar registration requirements.

This means that any judge's order, while perhaps worthy of title, will carry no weight past the front door of the recruiting station.

Fifteen years ago, a New York court made a similar order for Michael Guerra, who pleaded guilty to a felony and was sentenced to a year in prison. The army rejected this decision.

Military Service Is Not A Substitute For Jail Time

Guy Womack, a lawyer who specializes in military court cases, said: "I interpret this as an offer to forgive their crimes in return for doing something positive in their lives that can make them productive citizens. .”

"It can be a time when, especially in the draft era, there were a lot of people who didn't want to be involved," said Don Christensen, a retired Air Force judge and president of Protect Our Defenders, a nonprofit. . The organization is dedicated to ending violence. Racism in the military. "But the last thing you want is someone abusing their powers."

Nearly 50 years after the abolition of the draft and the rise of an all-volunteer military, recruiting standards for all branches have risen. Even if a job seeker has had a prior conviction dismissed, many different types of waivers are now required.

Military Or Jail

The military has become perhaps the country's most trusted national institution, making it a peculiar reservoir for the country's criminals.

Brevard Jail Death Of Army Veteran A Story Of Missed Chances And Questions

"There are concerns about accountability, rehabilitation and the cost of putting people in prison," Christensen said. "But it is not the role of the military to change that."

Recruiters often struggle to meet quotas. While someone can share their frustrations and recruiting dreams, and even offer their recruiter some choice words, positions generally seek people who stay out of jail. Want to serve in the army for reasons other than

This makes the idea of joining the military a literal substitute for going to jail. After all, people who haven't committed a particularly serious crime are likely to be in enough trouble already.

Deputies in the 31E military occupation, known as detention/detention specialists, are trained to be prison guards, and each was trained at Fort Leonard Wood, Company C, 701st Military Police Battalion.

Company C provides advanced private training for 31Es for seven weeks. Training includes communications, detainer restraint, contraband searches, unarmed self-defense and riot control.

During the course, trainees pass a "facility test" to obtain a prison management certificate. They can also run their prisons by taking turns being prisoners and guards. The existence of 31E ensures that all soldiers working in military prisons are treated to the same standards or prisoners. There are movies, TV shows, books and documentaries that give Americans a glimpse of what life is like behind bars in a civilian prison. . Unfortunately, what we see is violence, bad food, boredom and crowded people.

But there are also military prisons in America. Have you ever wondered how military prisons compare to civilian prisons? It turns out that these two organizations are completely different in a way that will surprise you.

Military prison guards are recruited from local military police units. Like civilian guards, their job is to ensure the safety of prisoners and maintain control while in custody.

Military guards take their role seriously. Their military training established a certain discipline and code of conduct that they brought to work.

Military Prisons Vs Civilian Prisons

This is not to say that civilian guards do not take their jobs seriously or that every military prison guard is perfect. An army guard, on the other hand, approaches his position with the same determination as a soldier in battle.

Prisoners of war are responsible for the cleanliness and maintenance of the prison. They must clean their cells and be responsible for any area of the prison, be it the bathroom, kitchen, gym or floor.

The future of Canada's military colleges is under scrutiny after former Supreme Court Justice Louise Arbour, in her comprehensive review of the Department of National Defense and the Armed Forces, questioned whether they should remain degree-granting institutions and recommended a review carry out their operations.

Military Or College

Military Or College

The Royal Military College in Kingston and its counterpart in Saint-Jean, Quebec have a long and distinguished history in shaping the officers who have commanded the Canadian armed forces. In the words of Ms. Arbour, the RMC students form an informal elite within the Canadian Forces.

Corps Of Cadets

But in his review, which focused on sexual misconduct in the military and leadership, Arbor raised questions about whether military training needs to be rethought.

- The military academies are seen as institutions from another time, with an outdated and problematic leadership model. There are legitimate reasons to question the wisdom of keeping these military colleges, as they currently are,” Arbor wrote.

"There is a lot of evidence that the military colleges are not fulfilling their mandate and I think other options need to be explored with an open mind."

She suggested that the colleges be reviewed by an external education specialist who would look at the quality of education, military training and socialization they provide. She said that other models for providing military training should be explored, and in particular the government recommends considering candidates who want to attend civilian universities and then attend a military institution for a year of education and training professional military.

Air Force Tuition Assistance

Arbor added that while these issues are being assessed, the government should take steps to address "the long-term cultural issues unique to the military college environment, including the persistent misogynistic and discriminatory environment and prevalence persistent sexual misconduct."

The two recommendations on education are not among those in the review that the government immediately accepted and promised to implement.

In a statement on Tuesday, the Department of Defense said that despite progress towards meaningful cultural change at RMC in recent years, it is clear that more work and change is needed.

The Chief of the Defense Staff, General Wayne Eyre, said at a press conference on Monday that the army would rethink its training system.

Valley Forge Military Academy And College Announces Changes To College Program

"Do we have the right model for Kingston and Saint-Jean, or is there another model that would serve us better?" he said. "We will study the proposal."

Almost every major army among Canada's allies has its own officer training institutions, a system that traces its roots to the specialization of warfare in the 19th century. RMC opened in the 1870s and today has over 1,000 full-time students, both graduate and undergraduate.

Questions about his direction remain for more than a decade. A 2017 audit report found that the RMC could not demonstrate that it was producing officers at a reasonable cost and that there were weaknesses in the training it provided. According to the auditor general, educating a student at RMC was about twice as expensive as other universities of the same size, and twice as expensive as producing officers through other means.

One of the arguments for a specialized military institution is that it socialises officers into the institution, but the Arbour report raised questions about various aspects of the environment at the RMC.

Citadel Military College Says Prospective Student Can't Wear Hijab

The student population is not as diverse as at other universities, with an undergraduate population at RMC last year that was about 22 per cent female and 24 per cent visible minorities, significantly different from other Ontario universities where women are often 50 per cent or more and visible. minorities are closer to 40 percent of the students.

A Statistics Canada survey of more than 500 respondents at RMC and Saint-Jean in 2020 found that 68 per cent said they had seen or experienced unwanted sexual behavior in the previous year. Arbor said the interviews her team conducted with students during their review were troubling.

"I was told that almost every female student suffered one or more incidents of sexual misconduct 'or worse,'" she wrote.

Military Or College

Arbor said her future proposals at RMC and Saint-Jean could involve significant and difficult changes. But it is time to reassess its role, she wrote.

Concerns Prompt Sweeping Review Of Royal Military College

"The many pressures of the military college environment reduce the quality of academic success, because so much is placed on a four-year college program," Arbor wrote.

The Royal Military College in Kingston and its counterpart in Saint-Jean, Quebec have a long and distinguished history in shaping the officers who have commanded the Canadian armed forces. In the words of Ms. Arbour, the RMC students form an informal elite within the Canadian Forces.
